Legal definition of rape in Ohio

Under the Ohio Code, rape is sexual conduct that is forced and involves vaginal, oral, or anal penetration, even if only to a slight extent. Penetration can be with a body part, instrument, apparatus, or some other object. One or more of the following elements are necessary for the act to qualify as rape:

  • Forced submission
  • Substantially impaired judgment through the use of drugs or intoxicants surreptitiously or by force
  • Compelled to submit by threat of force or deception
  • Person compelled to have sex is less than 13 years of age

Types of rape
