Nobody Talks, Everybody Walks. Ohio criminal defense lawyer with nearly 40 years experience

“When I was arrested by the Feds on Drug Conspiracy charges, they told me I was facing mandatory life in federal prison without the possibility of parole. I knew that I was innocent, but I was scared . . . so I knew that I would have to find a lawyer who was not afraid of the Feds and would take my case to trial. I chose Greg Robey because he is a fighter. After over 2 weeks in a federal jury trial, I was found Not Guilty of all charges. My family and I am forever grateful to Mr. Robey.” -L.B., Mansfield, Ohio

Legal definition of rape in Ohio

Under the Ohio Code, rape is sexual conduct that is forced and involves vaginal, oral, or anal penetration, even if only to a slight extent. Penetration can be with a body part, instrument, apparatus, or some other object. One or more of the following elements are necessary for the act to qualify as rape:

  • Forced submission
  • Substantially impaired judgment through the use of drugs or intoxicants surreptitiously or by force
  • Compelled to submit by threat of force or deception
  • Person compelled to have sex is less than 13 years of age

Types of rape

An Ohio rape defense lawyer represents clients against various types of rape allegations, such as:

  • Date rape. Date rape is forced sexual penetration while on a date, often associated with the use of a date rape drug.
  • Statutory rape. Person is not of legal age to consent to sexual intercourse. The Ohio Code does not have a statute for statutory rape. However, Ohio statutes address this type of rape under the rape definition and the section on unlawful sex with a minor.
  • Gang rape. Gang rape is forced penetration by several individuals in close succession.
  • Drug-facilitated rape. Drug-facilitated rape uses drugs or alcohol to lower the person's resistance and memory of sexual penetration. It also lowers the person’s ability to consent.
  • Marital rape. Marital rape is unwanted sexual penetration of a spouse that occurs through force, a threat of force, or drugs or alcohol.
